1. ACCEPTANCE OF TERMS

By accessing and using Eroteme ("the Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. PLATFORM DESCRIPTION

Eroteme is a decentralized marketplace for encrypted intelligence ("Intel") built on blockchain technology. Users can:

• Mint encrypted Intel as NFTs
• Request Intel from other users
• Buy and sell Intel NFTs through fixed-price listings or auctions
• Trade encrypted information securely using cryptographic keys

3. ELIGIBILITY

You must be at least 18 years old to use this Platform. By using Eroteme, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. WALLET CONNECTION AND BLOCKCHAIN TRANSACTIONS

To use Eroteme, you must connect a compatible Web3 wallet (e.g., MetaMask, WalletConnect, Coinbase Wallet, or other EIP-1193 compatible wallets). You acknowledge that:

• All transactions are processed on the Ethereum blockchain
• Blockchain transactions are irreversible
• You are responsible for the security of your wallet and private keys
• Gas fees are required for all blockchain transactions
• Eroteme does not have access to your private keys or wallet funds

5. FEES AND PAYMENTS

The Platform charges the following fees:

• Platform fee: 5% on all transactions
• Creator royalty: 10% on secondary sales (if applicable)
• Seller receives: 95% on initial sales, 85% on resales

All payments are processed in ETH (Ethereum). Prices may fluctuate based on market conditions.

6. CONTENT AND INTELLECTUAL PROPERTY

6.1 Your Content: You retain ownership of all Intel you create and mint on the Platform. By minting Intel, you grant the buyer a license to access and view the encrypted content.

6.2 Content Guidelines: You agree not to mint, share, or request Intel that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains illegal, harmful, or offensive content
• Promotes violence, hate speech, or discrimination
• Contains malware or malicious code
• Violates privacy rights or contains non-consensual intimate content

6.3 Platform Rights: Eroteme reserves the right to remove content that violates these terms.

7. NFT OWNERSHIP AND TRANSFERS

When you purchase an Intel NFT, you own the NFT itself but not necessarily the underlying intellectual property. NFT ownership grants you:

• The right to view decrypted content (after proper re-encryption)
• The right to resell or transfer the NFT
• The right to display or reference ownership of the NFT

The creator is responsible for re-encrypting content for new owners after a sale. If re-encryption is not completed within the deadline, buyers may claim a 98% refund.

8. RE-ENCRYPTION AND ACCESS

When Intel is sold:

• The seller must re-encrypt content for the buyer using the buyer's public key
• Re-encryption must occur within 7 days of the sale
• 98% of the sale price is held in the smart contract until re-encryption is complete
• If re-encryption is not completed by the deadline, the buyer can claim a refund
• For Intel requests, the requester automatically owns the NFT and can access content immediately

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY

9.1 No Warranties: The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

9.2 Content Accuracy: Eroteme does not verify the accuracy, legality, or quality of Intel listed on the Platform. Users transact at their own risk.

9.3 Technical Risks: You acknowledge the risks inherent in blockchain technology, including but not limited to:

• Smart contract bugs or vulnerabilities
• Network congestion and failed transactions
• Loss of private keys
• Regulatory changes affecting cryptocurrency

9.4 Limitation of Liability: To the maximum extent permitted by law, Eroteme shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

10. PROHIBITED ACTIVITIES

You agree not to:

• Use the Platform for any illegal purposes
• Attempt to manipulate prices or engage in wash trading
• Reverse engineer or attempt to hack the Platform
• Create fake accounts or impersonate others
• Spam, harass, or abuse other users
• Upload malicious code or malware
• Violate any applicable laws or regulations

11. PRIVACY AND DATA

Your use of the Platform is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

12. THIRD-PARTY SERVICES

The Platform integrates with third-party services including:

• Ethereum blockchain and Infura RPC
• Pinata (IPFS storage)
• Wallet providers (MetaMask, WalletConnect, Coinbase Wallet, and other compatible wallets)
• Chainlink price feeds

Eroteme is not responsible for the availability, accuracy, or functionality of these third-party services.

13. TERMINATION

We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

14. CHANGES TO TERMS

We may modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. GOVERNING LAW AND DISPUTES

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.

17. SEVERABILITY

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eroteme regarding the use of the Platform.
